On the morning of Feb. 23, 2006, she shot herself in the stomach killing her full-term baby.\u00a0 (Virginia, attempting to mitigate the current federal-court-imposed national abortion policy which has evolved into \u201cpartial birth abortions\u201d across the fruited plain, had outlawed abortions in the third trimester.\u00a0 Folks did not want to think themselves barbaric by allowing those babies which could easily survive if they should exit the womb to be butchered by abortion in Virginia.).\u00a0 Tammy Skinner is the mother of two daughters, ages 2 and 4.\u00a0 This third child was due the day she shot him.<\/p>\n
What is a magistrate to do?\u00a0 Let us imagine what the harried prosecutor, trying uphold the law, must consider.<\/p>\n
(Now, there are plenty of prosecutors who do not consider what the laws actually say and only prosecute those which are politically suitable to enforce.\u00a0 The shining example of this kind of selective prosecution is the various anti-sodomite statutes on the books of all the states which are regularly \u201cnol-pros-ed\u201d because of the public indifference to the conglomerate title wave of Hollywood, academia, media elite, and apostate churches which are sympathetic to sodomy rights.\u00a0 But let us imagine a prosecutor trying to follow the \u201claw\u201d here.)<\/p>\n
\u201cShe aborted her own child.\u00a0 Hmm.\u00a0 Unusual.\u201d<\/p>\n
\u201cPracticing medicine without a license?\u201d<\/p>\n
\u201cNah, that would be too weird.\u201d<\/p>\n
\u201cWell, she did abort her child beyond the age when a child may be aborted.\u00a0 That\u2019s the fact.\u00a0 Let\u2019s go for it.\u201d<\/p>\n
So the prosecution goes after her but the defense wins.\u00a0 Kevin Martingayle successfully argues that the Virginia statute under which she was charged was aimed at a third party, the abortionists, not at a mother.\u00a0 A wonderfully technical point which may get everyone out of the quagmire.<\/p>\n
Saved.\u00a0 Charges dismissed.<\/p>\n
Well there was another thing she did wrong, not as egregious as the murder.\u00a0 Skinner did file a false police report declaring that she had been shot by another person. \u00a0So the state charges her for\u00a0 $1,200 in restitution.<\/p>\n
\u201cOkay.\u00a0 We did something about this bloody case. Let\u2019s go home.\u201d<\/p>\n
\u201cAh but this just won\u2019t do!\u00a0 We can\u2019t have women killing their own children so crudely!\u00a0 We have more private, sanitized, and clinical ways of doing these things, even if they do cost poor mothers a bit more.\u00a0 This do-it-yourself-with-a-gun method is just too \u2026 too private!\u00a0 Too entrepreneurial, maybe!\u00a0 There has got to be more done about this.\u201d<\/p>\n
Prosecutors resumed the case in June by getting a grand jury to indict Skinner on the same charge, bypassing General District Court.\u00a0 She was re-indicted on 3 August under the law: Only kill babies when they are little;\u00a0 No killing big babies!<\/p>\n
\u201cSkinner was suffering from depression when she shot herself,\u201d according to reporter Dave Forster, (The Virginian-Pilot<\/em> , 4 August, 2006)).<\/p>\n Indeed, but what really drove the prosecutor to continue to give chase in this bizarre situation which abortion fans wish would just go away?<\/p>\n Methinks Prosecutor Jim Wizer gave it to us back in July: “She took a gun to herself and caused the loss of life of what would have been her child.\u00a0 She has two other children.
