There was a deliverance of hundreds and thousands of womb children from death. Children who would have died by him or under his oversight at the abortuary that he operated in Wichita are now alive.

The jury ought to be presented with all the facts. The age of the children killed in Tiller’s abortuary ought to be disclosed along with and the methods of killing and the number of deaths. The jury ought to be fully informed. The legal principle of necessity ought to be presented to the jury so that the citizens may be fully informed of the nature of our laws and judicial system as they apply their attention to this particular case.

THE NECESSITY DEFENSE

Every defendant has a right to a trial by a jury and he ought to be allowed to present his own defense, not one narrowly crafted by judges and prosecutors with their own ideological grievances or prejudices.

It is clear that abortion was outlawed throughout our nation and in western civilization for many centuries until a cadre of judges determined to subvert the laws of the lands with their landmark 1973 overthrow of the laws of all the states (except three which had begun to “liberalize” their views of sexual immorality and abortion scarcely a few years prior).

The fact that most of those citizens who were aghast by such a heinous perversion of justice responded with nothing more than mere verbal remonstration and pleas for “judicial review” and possible “Constitutional Amendments” for the next ten years did nothing to diminish the urgency or legitimacy of the forceful rescue of children which was exhibited in abundance by a few around the country a decade later. The bombings and burnings and various physical attacks on abortion facilities were tardy as a national response. And the terminations of a three abortionists in Florida and New York in the decade of the nineties was a more serious but very late response an ongoing holocaust which was then taking an annual 1.5 million lives.

In the name if truth and justice and in the hope of national repentance, may the reformation of our society begin with Kansas. Such a spirit was came once before upon a man named John Brown whose picture is painted in the halls of the capital in Topeka. It was another issue in another time, but it was a horrible injustice just the same. There is an opportunity in this trial for the people, represented by the jurors, to recover themselves from the ethical stupor in which the nation has continued to flounder.

Michael Bray August, 2009 A Short Response to the Termination of Tiller.
